Sample Letter to Landlord: Return of Security Deposit - Improper Procedure

The following document ONLY applies to jurisdictions in Kentucky that have enacted the Uniform Residential Landlord Tenant Act. These jurisdictions are: Barbourville, Bellevue, Bromley, Covington, Dayton, Florence, Lexington-Fayette County, Georgetown, Louisville-Jefferson County, Ludlow, Melbourne, Newport, Oldham County, Pulaski County, Shelbyville, Silver Grove, Southgate, Taylor Mill and Woodlawn.

Further, this information only applies to residential leases. It does not apply to: commercial units, properties under contract for sale, hotels or motels, or people who are employed by the landlord.

Here is a sample letter you can send your landlord requesting the return of your security deposit because he or she did not follow the proper procedures for keeping it. See Tenant's Guide to Security Deposit Problems for more information.

Dear Landlord:

Please be advised that because of the acts or omissions identified below and failure to perform your statutory obligations of KRS 383.580, that you are not entitled to retain any portion of my security deposit.

(    )      You did not place my security deposit in an account used only for that purpose.

(    )      You did not inform me of the location of the separate account and the account number.

(    )      I was not presented with a comprehensive listing or accounting of existing damage to my dwelling unit which would be the basis for a charge against the security deposit or the estimated dollar cost of repairing such damage prior to giving you my security deposit.

(    )     I was not presented with this comprehensive list at any time.

(    )     I was not allowed to inspect the premises before I moved in to see if the comprehensive list was correct.

(    )     You failed to sign the comprehensive list.

(    )     When I moved out you did not inspect the premises and make a comprehensive list of any damage which could be the basis for a charge against the security deposit and/or the estimated cost of repairing the damage.

(    )     I was not allowed to inspect the premises after I moved out to see if this final comprehensive list was correct.

(    )     You did not sign this final list.

(    )     You prevented me from signing this final list.

(    )     I have given you in writing the items on the lists that I disagree with and I signed that statement and delivered it to you on the ______ day of ____________________, 20___.


Therefore, please return the full portion of my security deposit in the amount of $____________ within ten (10) days or I shall take legal action. Please mail my security deposit to:
